While the 341 meeting may feel like a significant milestone (and it is), several important steps still lie ahead before your case is finalized.<\/p>\n<p>Whether you\u2019re filing Chapter 7 or Chapter 13 bankruptcy in the Middle or Western District of North Carolina, here\u2019s what to expect after your \u00a7 341 meeting of creditors:<\/p>\n<p><span data-preserver-spaces=\"true\">Before receiving your <\/span><strong><span data-preserver-spaces=\"true\">discharge<\/span><\/strong><span data-preserver-spaces=\"true\"> in either a Chapter 7 or Chapter 13 bankruptcy, you must complete a <\/span><strong><span data-preserver-spaces=\"true\">Financial Management Course<\/span><\/strong><span data-preserver-spaces=\"true\">, also known as the Debtor Education course. <\/span><span data-preserver-spaces=\"true\">This<\/span><span data-preserver-spaces=\"true\"> differs<\/span><strong><span data-preserver-spaces=\"true\"> from the credit counseling course<\/span><\/strong><span data-preserver-spaces=\"true\"> you completed before filing your case.<\/span><\/p>\n<p><strong><span data-preserver-spaces=\"true\">Here\u2019s what you need to know:<\/span><\/strong><\/p>\n<ul>\n<li><span data-preserver-spaces=\"true\">\u2705 <\/span><strong><span data-preserver-spaces=\"true\">It\u2019s required by law<\/span><\/strong><span data-preserver-spaces=\"true\"> \u2014 under 11 U.S.C. \u00a7 727(a)(11) for Chapter 7 and \u00a7 1328(g)(1) for Chapter 13.<\/span><\/li>\n<li><span data-preserver-spaces=\"true\">\u23f3 <\/span><strong><span data-preserver-spaces=\"true\">Deadline for Chapter 7:<\/span><\/strong><span data-preserver-spaces=\"true\"> Must be completed and filed <\/span><strong><span data-preserver-spaces=\"true\">within 60 days after your 341 meeting<\/span><\/strong><span data-preserver-spaces=\"true\">.<\/span><\/li>\n<li><span data-preserver-spaces=\"true\">\u23f3 <\/span><strong><span data-preserver-spaces=\"true\">Deadline for Chapter 13:<\/span><\/strong><span data-preserver-spaces=\"true\"> Must be completed <\/span><strong><span data-preserver-spaces=\"true\">before filing your Motion for Entry of Discharge<\/span><\/strong><span data-preserver-spaces=\"true\"> at the end of your case.<\/span><\/li>\n<li><span data-preserver-spaces=\"true\">???? <\/span><strong><span data-preserver-spaces=\"true\">You must file Form 423 (Certification)<\/span><\/strong><span data-preserver-spaces=\"true\"> with the Bankruptcy Court to prove you\u2019ve completed the course. <\/span><span data-preserver-spaces=\"true\">If you completed the course with the <\/span><span data-preserver-spaces=\"true\">company<\/span> <span data-preserver-spaces=\"true\">recommended<\/span><span data-preserver-spaces=\"true\">, that certificate <\/span><span data-preserver-spaces=\"true\">is automatically filed<\/span><span data-preserver-spaces=\"true\"> on your behalf.<\/span><\/li>\n<\/ul>\n<p><strong><span data-preserver-spaces=\"true\">If you don\u2019t complete the course:<\/span><\/strong><\/p>\n<p><span data-preserver-spaces=\"true\"> Your case can be <\/span><strong><span data-preserver-spaces=\"true\">closed without a discharge<\/span><\/strong><span data-preserver-spaces=\"true\">, so <\/span><span data-preserver-spaces=\"true\">your debts won\u2019t be eliminated<\/span><span data-preserver-spaces=\"true\">. <\/span><span data-preserver-spaces=\"true\">You would then need to file a motion (and likely pay a fee) to reopen the case <\/span><span data-preserver-spaces=\"true\">just<\/span><span data-preserver-spaces=\"true\"> to file the certificate.<\/span><\/p>\n<h2><span data-preserver-spaces=\"true\">???? For Chapter 7 Cases<\/span><\/h2>\n<p><strong><span data-preserver-spaces=\"true\">1. Waiting Period for Objections<\/span><\/strong><\/p>\n<p><span data-preserver-spaces=\"true\"> Creditors and the Bankruptcy Administrator have 60 days from your 341 meeting to file objections to discharge or dischargeability under 11 U.S.C. \u00a7 523 and \u00a7 727.<\/span><\/p>\n<p><strong><span data-preserver-spaces=\"true\">2. Document Follow-Up<\/span><\/strong><\/p>\n<p><span data-preserver-spaces=\"true\"> You may <\/span><span data-preserver-spaces=\"true\">be asked<\/span><span data-preserver-spaces=\"true\"> to provide additional documents to the Trustee. Promptly comply to avoid delays or potential dismissal.<\/span><\/p>\n<p><strong><span data-preserver-spaces=\"true\">3. Nonexempt Property Review<\/span><\/strong><\/p>\n<p><span data-preserver-spaces=\"true\"> If you <a href=\"https:\/\/www.duncanlawonline.com\/what-happens-to-property-that-cannot-be-protected-in-bankruptcy\/\">own nonexempt assets<\/a> (things that <\/span><span data-preserver-spaces=\"true\">can\u2019t be protected<\/span><span data-preserver-spaces=\"true\"> under NC exemption laws), the Trustee may administer those for the benefit of creditors. <\/span><span data-preserver-spaces=\"true\">This<\/span><span data-preserver-spaces=\"true\"> might involve:<\/span><\/p>\n<ul>\n<li><span data-preserver-spaces=\"true\">Selling property<\/span><\/li>\n<li><span data-preserver-spaces=\"true\">Negotiating buybacks<\/span><\/li>\n<li><span data-preserver-spaces=\"true\">Filing motions for turnover<\/span><\/li>\n<\/ul>\n<p><strong><span data-preserver-spaces=\"true\">4. Reaffirmation Agreements or Redemptions<\/span><\/strong><\/p>\n<p><span data-preserver-spaces=\"true\"> If you\u2019re keeping secured property like a vehicle, you may:<\/span><\/p>\n<ul>\n<li><span data-preserver-spaces=\"true\"><a href=\"https:\/\/www.duncanlawonline.com\/reaffirmation-agreement\/\">Reaffirm<\/a> the debt (agree to keep paying it)<\/span><\/li>\n<li><span data-preserver-spaces=\"true\">Redeem the item (pay fair market value)<\/span><\/li>\n<li><span data-preserver-spaces=\"true\">Surrender it (walk away from it)<\/span><\/li>\n<\/ul>\n<p><strong><span data-preserver-spaces=\"true\">5. For Chapter 13 Cases<\/span><\/h2>\n<p><strong><span data-preserver-spaces=\"true\">1. Objections to Confirmation<\/span><\/strong><\/p>\n<p><span data-preserver-spaces=\"true\"> The Trustee, creditors, or Bankruptcy Administrator may file objections to your plan. Most objections <\/span><span data-preserver-spaces=\"true\">are resolved<\/span><span data-preserver-spaces=\"true\"> through amendments or informal agreements.<\/span><\/p>\n<p><strong><span data-preserver-spaces=\"true\">2. Plan Confirmation Hearing<\/span><\/strong><\/p>\n<p><span data-preserver-spaces=\"true\"> The court will review your repayment plan. <\/span><span data-preserver-spaces=\"true\">This<\/span><span data-preserver-spaces=\"true\"> often happens 45\u201360 days after your case <\/span><span data-preserver-spaces=\"true\">is filed<\/span><span data-preserver-spaces=\"true\"> in the Middle District and Western District of North Carolina. The plan is confirmed if the Trustee supports confirmation and no unresolved objections exist.<\/span><\/p>\n<p><strong><span data-preserver-spaces=\"true\">3. Begin Payments Immediately<\/span><\/strong><\/p>\n<p><span data-preserver-spaces=\"true\"> You must start making payments to the Trustee within 30 days of filing, even before confirmation. Failure to do so may lead to dismissal.<\/span><\/p>\n<p><strong><span data-preserver-spaces=\"true\">4. Claims Review<\/span><\/strong><\/p>\n<p><span data-preserver-spaces=\"true\"> Creditors have a set deadline (usually 70 days from the petition date for non-governmental creditors) to file a proof of claim. The Trustee will review these and may object to improper claims.<\/span><\/p>\n<p><strong><span data-preserver-spaces=\"true\">5. Stay the Course<\/span><\/strong><\/p>\n<p><span data-preserver-spaces=\"true\"> Assuming confirmation, you must:<\/span><\/p>\n<ul>\n<li><span data-preserver-spaces=\"true\">Stay current on Trustee payments<\/span><\/li>\n<li><span data-preserver-spaces=\"true\">File yearly tax returns<\/span><\/li>\n<li><span data-preserver-spaces=\"true\">Report any changes in income or assets<\/span><\/li>\n<li><span data-preserver-spaces=\"true\">Get approval before incurring new debt (e.g., car loan or mortgage refinance)<\/span><\/li>\n<\/ul>\n<p><strong><span data-preserver-spaces=\"true\">6. Completing the Plan &amp; Discharge (3\u20135 Years Later)<\/span><\/strong><\/p>\n<p><span data-preserver-spaces=\"true\"> After completing all plan payments, the Trustee will file a notice of plan completion.
