{"id":3720,"date":"2010-10-07T02:13:43","date_gmt":"2010-10-07T02:13:43","guid":{"rendered":"http:\/\/www.duncanlawonline.com\/?p=3720"},"modified":"2015-04-11T23:04:13","modified_gmt":"2015-04-11T23:04:13","slug":"workers-compensation-benefits-determined","status":"publish","type":"post","link":"https:\/\/www.duncanlawonline.com\/staging\/8350\/workers-compensation-benefits-determined\/","title":{"rendered":"How Are Workers&#039; Compensation Benefits Determined?"},"content":{"rendered":"<p>http:\/\/www.youtube.com\/watch?v=Usrhdp2vVLI <\/p>\n<div style=\"margin-bottom: 2em;\"><span style=\"display: none;\">.<\/span><\/div>\n<p>Workers\u2019s compensation benefits are determined by a variety of factors.\u00a0 One of the first questions is whether the injured worker is able to return to their job?\u00a0 When a worker is injured on the job they are sent to a physician to determine the extent of their injury.\u00a0 The physician may allow the worker to return to work and they will receive their regular salary as they perform their regular work duties.<\/p>\n<p>On the other hand, the physician may determine the employee cannot work their regular job and may allow the worker to work, for example, only 20 hours per week.\u00a0 If they are seriously injured, the physician may not allow them to return to the job until they reach what is known as \u201cmaximum medical improvement\u201d or &#8220;M.M.I.&#8221;.\u00a0 If the worker is unable to work their full schedule or a partial schedule, the employer\u2019s workers&#8217; compensation insurance company must compensate the injured worker\u2019s benefits, such as salary, the worker would had received if they had not been injured.<\/p>\n<p>Normally, the injured worker receives two-thirds of their average weekly wages lost due to the injury. The worker usually receives a weekly paycheck from their employer\u2019s workers&#8217; compensation insurance company to compensate the worker due to the lost time because of the injury.<\/p>\n<p><img decoding=\"async\" loading=\"lazy\" class=\"alignleft size-medium wp-image-3729\" style=\"margin-left: 0px; margin-right: 10px;\" title=\"Doctor Examining an X-Ray | Workers' Compensation\" src=\"https:\/\/www.duncanlawonline.com\/wp-content\/uploads\/2010\/10\/XRay-Doctor-300x199.jpg\" alt=\"Doctor Examining an X-Ray | Workers' Compensation\" width=\"300\" height=\"199\" \/><\/p>\n<p>You may ask why only two thirds of the average weekly wages? \u00a0The general consensus is if the worker is receiving \u201cfull\u201d benefits or 100% of their usual income, the worker would have no \u201cincentive\u201d to return to work.\u00a0 Also the worker does not have to pay transportation cost or wear and tear on a vehicle if they are at home injured.
