Comp Laws Protect Independent Contractors in North Carolina?"},"content":{"rendered":"<p>The short answer is no, an independent contractor is not covered by <a title=\"Workers' Compensation Attorneys in North Carolina\" href=\"https:\/\/www.duncanlawonline.com\/workers-compensation\/\" target=\"_self\">Workers\u2019 Compensation<\/a> laws in North Carolina.\u00a0 However, the answer really depends on the situation.\u00a0 If the independent contractor is:<\/p>\n<p style=\"padding-left: 60px;\">performing the functions of an employee,<\/p>\n<p style=\"padding-left: 60px;\">taking guidance and direction from the employer,<\/p>\n<p style=\"padding-left: 60px;\">has his or her hours set by the employer,<\/p>\n<p style=\"padding-left: 60px;\">working for no other employer, and<\/p>\n<p style=\"padding-left: 60px;\">basically acting as an employee<\/p>\n<p>then the North Carolina Industrial Commission may view this person as an employee rather than an independent contractor.\u00a0 As a result, this person may be covered by the <a title=\"Workers' Compensation Act in North Carolina\" href=\"http:\/\/www.ic.nc.gov\/ncic\/pages\/statute.htm\" target=\"_blank\">Workers\u2019 Compensation Act in North Carolina<\/a>.<\/p>\n<p><img decoding=\"async\" loading=\"lazy\" class=\"alignleft size-medium wp-image-3751\" style=\"margin-left: 0px; margin-right: 10px;\" title=\"North Carolina Flag\" src=\"https:\/\/www.duncanlawonline.com\/wp-content\/uploads\/2010\/10\/North-Carolina-Flag-300x238.jpg\" alt=\"North Carolina Flag\" width=\"240\" height=\"190\" \/><\/p>\n<p>An independent contractor who has multiple \u201cemployers\u201d or clients, sets his\/her own hours for work, and performs the job independent of the client employer will most likely not be covered by the Workers\u2019 Compensation Act in North Carolina.<\/p>\n<p>Examples are often the most helpful.<\/p>\n<p style=\"padding-left: 60px;\">Probably \u201cemployee\u201d \u2013 A person is hired as an independent contractor to enter data.\u00a0 This person is given specific hours to work, takes direction from a supervisor within the company, and attends training classes for the company.\u00a0 This person will most likely be considered an employee by the North Carolina Industrial Commission.<\/p>\n<p style=\"padding-left: 60px;\">Independent Contractor \u2013 A person is hired to enter data.\u00a0 The person decides the hours of the day they work.\u00a0 The person provides the services from their home and\/or the employer\u2019s office.\u00a0\u00a0 The person takes limited or no direction from the employer as long as the job gets completed.\u00a0 This person will most likely be considered an independent contractor by the North Carolina Industrial Commission.<\/p>\n<p>Independent contractors are not specifically defined by the <a title=\"North Carolina Industrial Commission\" href=\"http:\/\/www.ic.nc.gov\/\" target=\"_blank\">North Carolina Industrial Commission<\/a>, however, employees are defined by North Carolina General Statute, Section 97-2 of the Workers\u2019 Compensation Act.\u00a0\u00a0 The term &#8220;employee&#8221;
