{"id":4506,"date":"2011-06-03T09:00:58","date_gmt":"2011-06-03T09:00:58","guid":{"rendered":"http:\/\/www.duncanlawonline.com\/?p=4506"},"modified":"2026-06-07T00:43:19","modified_gmt":"2026-06-07T04:43:19","slug":"are-debts-ordered-in-a-separation-agreement-dischargeable-in-bankruptcy","status":"publish","type":"post","link":"https:\/\/www.duncanlawonline.com\/staging\/8350\/are-debts-ordered-in-a-separation-agreement-dischargeable-in-bankruptcy\/","title":{"rendered":"Are Debts Ordered in a Separation Agreement Dischargeable in Bankruptcy?"},"content":{"rendered":"<p>When the <a title=\"Bankruptcy Abuse Prevention and Consumer Protection Act\" href=\"http:\/\/en.wikipedia.org\/wiki\/Bankruptcy_Abuse_Prevention_and_Consumer_Protection_Act\">Bankruptcy Abuse Prevention and Consumer Protection Act of 2005<\/a> (BAPCPA) became effective October 17, 2005, debts ordered in a separation agreement, divorce decree or other order of the Court became non-dischargeable.\u00a0 This can be reviewed in detail at <a title=\"\u00a7 523 Exceptions to Discharge\" href=\"http:\/\/www.law.cornell.edu\/uscode\/usc_sec_11_00000523----000-.html\">11 U.S.C \u00a7 523(a)(5)<\/a> and <a title=\"523(a)(15)\" href=\"http:\/\/www.law.cornell.edu\/uscode\/usc_sec_11_00000523----000-.html\">523(a)(15)<\/a>.\u00a0 Domestic support obligations, inclusive of alimony, child support and other debts ordered to be paid by the court, cannot be eliminated in <a title=\"Information About Filing Bankruptcy in NC\" href=\"https:\/\/www.duncanlawonline.com\/bankruptcy\/\">bankruptcy<\/a> regardless of whether it is ordered before, during or after the date of the bankruptcy filing.\u00a0 In addition, the debts cannot be eliminated regardless who is owed the debt \u2013 spouse, ex-spouse, child, guardian of the child or a governmental unit.\u00a0 1 U.S.C \u00a7 101(14A).<\/p>\n<p>If you are in the process of a separation and divorce, it is important to understand what you are obligating yourself to pay prior to signing the paperwork.\u00a0 A couple of common examples are provided below:<\/p>\n<p><img decoding=\"async\" loading=\"lazy\" class=\"alignleft size-medium wp-image-8176\" src=\"https:\/\/www.duncanlawonline.com\/wp-content\/uploads\/2015\/04\/Computer-200x300.jpg\" alt=\"Legal Research on White Laptop\" width=\"200\" height=\"300\" srcset=\"https:\/\/www.duncanlawonline.com\/staging\/8350\/wp-content\/uploads\/2015\/04\/Computer-200x300.jpg 200w, https:\/\/www.duncanlawonline.com\/staging\/8350\/wp-content\/uploads\/2015\/04\/Computer.jpg 283w\" sizes=\"auto, (max-width: 200px) 100vw, 200px\" \/><\/p>\n<p><strong><span style=\"text-decoration: underline;\">Example One<\/span><\/strong>: You and your soon to be ex-spouse have a credit card with a balance of $10,000.\u00a0 You and your spouse incurred this debt when trying to start a business.\u00a0 During the negotiations of the separation agreement, you decide to take responsibility for the credit card.\u00a0 You feel this is the right thing to do since you pushed the development of the business.\u00a0 In this case, your spouse is \u201cheld harmless\u201d for this credit card balance.\u00a0\u00a0 As a result, you must pay this debt.<\/p>\n<p><strong><span style=\"text-decoration: underline;\">Example Two<\/span><\/strong>:\u00a0 You and your ex-spouse own a home.\u00a0 Your ex-spouse and two children live in the home and want to continue to live in the property.\u00a0 Both of your names are on the first mortgage loan but only your name is on the second mortgage.\u00a0 You have agreed in the divorce decree to pay the mortgages on the home until your youngest child graduates from high school.\u00a0 Once again, since you took responsibility for the debts under the divorce decree, you cannot file bankruptcy to eliminate the debts on the two loans.\u00a0 You are now solely responsible for the debt on the house.<\/p>\n<p>There are obviously many examples, but these are two of the more common scenarios we see at Duncan Law.\u00a0 \u00a0\u00a0Again, it is extremely important to assess your ability to pay prior to accepting responsibility for the debt\u00b8 since it will not be dischargeable in bankruptcy.<\/p>\n","protected":false},"excerpt":{"rendered":"","protected":false},"author":3,"featured_media":0,"comment_status":"closed","ping_status":"closed","sticky":false,"template":"","format":"video","meta":{"nf_dc_page":"","_jetpack_memberships_contains_paid_content":false,"footnotes":""},"categories":[4171,4168],"tags":[],"class_list":["post-4506","post","type-post","status-publish","format-video","hentry","category-bankruptcy-basics","category-credit-and-debt","post_format-post-format-video"],"yoast_head":"<!-- This site is optimized with the Yoast SEO Premium plugin v27.7 (Yoast SEO v27.7) - https:\/\/yoast.com\/product\/yoast-seo-premium-wordpress\/ -->\n<title>Divorce Debts &amp;
