{"id":4829,"date":"2011-09-22T09:00:24","date_gmt":"2011-09-22T09:00:24","guid":{"rendered":"http:\/\/www.duncanlawonline.com\/?p=4829"},"modified":"2015-04-13T00:11:31","modified_gmt":"2015-04-13T00:11:31","slug":"mortgage-companies-taking-long-time-to-foreclose","status":"publish","type":"post","link":"https:\/\/www.duncanlawonline.com\/staging\/8350\/mortgage-companies-taking-long-time-to-foreclose\/","title":{"rendered":"Mortgage Companies Are Taking A Long Time to Foreclose, Isn\u2019t That A Good Thing for Me?"},"content":{"rendered":"<p><iframe loading=\"lazy\" title=\"Is It A Good Thing Mortgage Companies Are Taking So Long to Foreclose?\" width=\"1200\" height=\"675\" src=\"https:\/\/www.youtube.com\/embed\/FrT4QwwSdAQ?wmode=transparent&amp;rel=0&amp;feature=oembed\" frameborder=\"0\" allow=\"accelerometer; autoplay; clipboard-write; encrypted-media; gyroscope; picture-in-picture; web-share\" referrerpolicy=\"strict-origin-when-cross-origin\" allowfullscreen><\/iframe><\/p>\n<p align=\"left\">As discussed in a previous blog post, it is <a title=\"Why is it taking mortgage companies so long to foreclose on properties?\" href=\"https:\/\/www.duncanlawonline.com\/why-is-it-taking-mortgage-companies-so-long-to-foreclose-on-houses\" target=\"_blank\">taking mortgage companies an extraordinary period of time to foreclose<\/a> on properties these days.\u00a0 Unfortunately, the delay in the foreclose process seems to be a \u201cdouble-edged sword\u201d depending on the homeowners\u2019 goals.<\/p>\n<p><a style=\"text-align: -webkit-left;\" href=\"https:\/\/www.duncanlawonline.com\/wp-content\/uploads\/2011\/09\/Foreclosure-Sign-in-Front-of-House.jpg\"><img decoding=\"async\" loading=\"lazy\" class=\"alignleft size-medium wp-image-4830\" style=\"margin-left: 0px; margin-right: 10px;\" title=\"Mortgage Company Foreclosing on House\" src=\"https:\/\/www.duncanlawonline.com\/wp-content\/uploads\/2011\/09\/Foreclosure-Sign-in-Front-of-House-300x199.jpg\" alt=\"Mortgage Company Foreclosing on House\" width=\"300\" height=\"199\" \/><\/a><\/p>\n<p align=\"left\">In some cases, it is a benefit to the homeowners, since they may be able to live in their home for a year or more before the foreclosure is completed.\u00a0 This delay allows the family to stay in \u201ctheir\u201d home and allows their children to finish the school year in a familiar setting with friends and teachers they adore.\u00a0 In other cases, it is purely a financial decision.\u00a0 The delay provides time for the family to save money, since they are not paying the mortgage loan on the house or rent on another property.\u00a0 When the day comes to move out of the home, the family has the funds needed for moving costs and for the security deposit and rent on the new apartment or house.<\/p>\n<p align=\"left\">On the other hand, the family down the street has made the decision to move on with their lives and have already moved out of the house.\u00a0 The house represents a negative time in their lives and they want a fresh start in new surroundings.\u00a0 In other cases, a member of the family has accepted a new job in another state, so they have no option but to move.\u00a0 These homeowners want the mortgage company to foreclose as soon as possible so this chapter of their lives can be closed.\u00a0 The family has moved on, unfortunately the house is still legally their responsibility.\u00a0 These families receive stack after stack of letters from the mortgage company offering workout plans and other alternatives to foreclosure.\u00a0 On top of that, the homeowners association (HOA) is sending threatening letters regarding tall grass growing in the law, mosquitoes in the swimming pool, and delinquent assessments, dues and fees.\u00a0 The HOA is threatening to file a lawsuit against the homeowners if they do not pay the debt.\u00a0 Pay a debt to the HOA for a house they do not live in?\u00a0 Yes, the HOA assessments, dues and fees are still the homeowners\u2019 financial responsibility until the property is no longer in their names, so the HOA debt must be paid.\u00a0 As the old saying goes, these families can\u2019t get the \u201cmonkey, aka house, off their backs\u201d!<\/p>\n<p align=\"left\">As a result, the delay in foreclosing on a house can be a good or bad thing depending on the homeowners\u2019 goals. \u00a0As the homeowners, you can ask the mortgage company to expedite the foreclosure sale but often that is unsuccessful.\u00a0 You can also look at signing a <a title=\"Bankruptcy v.
