{"id":5343,"date":"2012-04-19T09:00:33","date_gmt":"2012-04-19T09:00:33","guid":{"rendered":"http:\/\/www.duncanlawonline.com\/?p=5343"},"modified":"2026-06-07T00:39:26","modified_gmt":"2026-06-07T04:39:26","slug":"can-hoa-foreclose-if-i-dont-pay-my-dues","status":"publish","type":"post","link":"https:\/\/www.duncanlawonline.com\/staging\/8350\/can-hoa-foreclose-if-i-dont-pay-my-dues\/","title":{"rendered":"Can the Homeowners\u2019 Association (HOA) Foreclose If I Don\u2019t Pay My Dues?"},"content":{"rendered":"<p><iframe loading=\"lazy\" title=\"Can A Homeowners&amp;apos; Association Foreclose On My House?\" width=\"1200\" height=\"675\" src=\"https:\/\/www.youtube.com\/embed\/5nHoWEKMvpY?wmode=transparent&amp;rel=0&amp;feature=oembed\" frameborder=\"0\" allow=\"accelerometer; autoplay; clipboard-write; encrypted-media; gyroscope; picture-in-picture; web-share\" referrerpolicy=\"strict-origin-when-cross-origin\" allowfullscreen><\/iframe><\/p>\n<p>Many people have been led to believe that a homeowners\u2019 association cannot foreclose on their home.\u00a0 That is not true!\u00a0 Homeowners\u2019 associations foreclose on property everyday across America and very likely everyday in North Carolina.<\/p>\n<p><img decoding=\"async\" loading=\"lazy\" class=\"alignleft size-medium wp-image-5344\" title=\"Happy Family Standing Together\" src=\"https:\/\/www.duncanlawonline.com\/wp-content\/uploads\/2012\/03\/Happy-Family-Piggyback-White-300x205.jpg\" alt=\"Happy Family Standing Together\" width=\"300\" height=\"205\" \/><\/p>\n<p>If your neighborhood has a homeowners\u2019 association, you received and signed documents acknowledging the association\u2019s rights when you purchased your lot or home.\u00a0 As a matter of fact, participation in the homeowners\u2019 association was not an option for you, it was a requirement if you wanted to purchase your lot or home!\u00a0 \u00a0Many people do not read the documents and realize the requirements and powers of the homeowners\u2019 association when they purchase their property, since it was just one of the many documents signed the day of closing.<\/p>\n<p>Your neighborhood will have bylaws and covenants that are specific to your homeowners\u2019 association, but it is under <a href=\"http:\/\/www.ncleg.net\/EnactedLegislation\/Statutes\/HTML\/BySection\/Chapter_47F\/GS_47F-3-116.html\">North Carolina General Statutes Chapter 47F<\/a> that all homeowners\u2019 associations obtain their power.\u00a0\u00a0 \u00a0Under Chapter 47F-3-116 Lien for assessments, the homeowners\u2019 association can place a lien on your home or lot if you do not pay your assessment.\u00a0 If the amount owed is \u201c\u2026unpaid for a period of 30 days or longer\u2026\u201d the homeowners\u2019 association may file a lien on your property with the Clerk of Superior Court.\u00a0 The statute provides the timelines, procedures and notice requirements for filing the lien.\u00a0 If the homeowners association files a lien on our property and the assessment remains unpaid for 90 days or more, the homeowners\u2019 association may foreclose on the property just like your mortgage companies.<\/p>\n<p>Unfortunately, many homeowners ignore the letters they receive from their homeowners\u2019 association.\u00a0 Most often the letters are ignored because the homeowner does not realize the power provided to the homeowners\u2019 association.\u00a0 In other cases, the amount owed to the homeowners\u2019 association seems immaterial compared with the monthly mortgage payment(s), so the homeowner does not expect the association to proceed with foreclosure.\u00a0 Regardless, the homeowners\u2019 association has the right to, and often will, foreclose for what might seem like small dollar amounts.\u00a0 There have been many cases when the attorney\u2019s fee associated with the foreclosure is more than the homeowners\u2019 assessment amount.\u00a0 The key is to never ignore the letters from the homeowners\u2019 association; otherwise, you may discover you no longer own your home or lot.\u00a0 Filing <a title=\"Chapter 13 Bankruptcy Stopping Foreclosure\" href=\"https:\/\/www.duncanlawonline.com\/bankruptcy\/bankruptcy-types\/chapter-13-bankruptcy\/\" target=\"_blank\">Chapter 13 bankruptcy<\/a> can stop foreclosure proceedings, so you may want to see if this is an option if you find the homeowners\u2019 association foreclosing on your property.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Many people have been led to believe that a homeowners\u2019 association cannot foreclose on their home.\u00a0 That is not true!\u00a0 Homeowners\u2019 associations foreclose on property everyday across America and very likely everyday in North Carolina.
