{"id":5525,"date":"2024-01-29T23:02:10","date_gmt":"2024-01-30T04:02:10","guid":{"rendered":"http:\/\/www.duncanlawonline.com\/?p=5525"},"modified":"2026-06-03T08:57:01","modified_gmt":"2026-06-03T12:57:01","slug":"what-is-the-homestead-exemption-in-bankruptcy","status":"publish","type":"post","link":"https:\/\/www.duncanlawonline.com\/staging\/8350\/what-is-the-homestead-exemption-in-bankruptcy\/","title":{"rendered":"What is the Homestead Exemption in Bankruptcy?"},"content":{"rendered":"<p>One of the first questions we often hear from our clients is \u201cwhat will happen to my property in bankruptcy?\u201d\u00a0 It is often a confusing process and can be difficult to understand, which is why it is important to have a good bankruptcy attorney leading the way.<\/p>\n<p>Most of the time your <a title=\"Is Property Protected in Bankruptcy?\" href=\"https:\/\/www.duncanlawonline.com\/how-is-my-property-protected-in-bankruptcy\/\" target=\"_blank\" rel=\"noopener\">property is protected in bankruptcy<\/a>. Federal and state laws allow us to use what are called \u201cexemptions\u201d to help protect certain amounts of a family\u2019s real and personal property.\u00a0 This may include a home, vehicle, retirement savings, bank accounts, furniture, and any other property you may have.\u00a0 Obviously, one of the most important pieces of property to protect is a family\u2019s home if they want to continue to stay in their residence. So, how is a residential property protected in bankruptcy? By using a tool called the homestead exemption.<\/p>\n<p><img decoding=\"async\" loading=\"lazy\" class=\"alignleft size-medium wp-image-8184\" src=\"https:\/\/www.duncanlawonline.com\/wp-content\/uploads\/2015\/04\/Family-in-Front-of-House-200x300.jpg\" alt=\"Family in Front of House\" width=\"200\" height=\"300\" srcset=\"https:\/\/www.duncanlawonline.com\/staging\/8350\/wp-content\/uploads\/2015\/04\/Family-in-Front-of-House-200x300.jpg 200w, https:\/\/www.duncanlawonline.com\/staging\/8350\/wp-content\/uploads\/2015\/04\/Family-in-Front-of-House.jpg 283w\" sizes=\"auto, (max-width: 200px) 100vw, 200px\" \/>An individual or family\u2019s home can be protected with what is called the homestead exemption in bankruptcy. \u00a0An important thing to keep in mind is \u201chomestead\u201d means your residence at the time of filing bankruptcy and is utilized for those clients who have a residential property.\u00a0 In other words, if you are renting you will not likely come across the homestead exemption in your bankruptcy because you don\u2019t have any equity in the property since it is only a rental.<\/p>\n<p>North Carolina laws allow us to protect $35,000 in equity per individual&#8217;s name on the deed. For a married couple that has both of their names on the deed to a residence, we can exempt up to $70,000 in equity in their residence. Therefore, you can understand the importance of checking your property to see whose names are on the deed to the property. (Note: In North Carolina, most married couples will have both of their names on the deed but may have only one name on the mortgage or deed of trust.)<\/p>\n<p>In determining how to best use the homestead exemption we would first want to find out what the person\u2019s situation is on their home.\u00a0 Are they current?\u00a0 Behind?\u00a0 Are they able to get caught up before filing bankruptcy?\u00a0 The answers to all of those questions affect whether the client would be filing a <a title=\"Chapter 7 Bankruptcy Attorneys\" href=\"https:\/\/www.duncanlawonline.com\/bankruptcy\/bankruptcy-types\/chapter-7-bankruptcy\/\" target=\"_blank\" rel=\"noopener\">Chapter 7 bankruptcy<\/a> or <a title=\"Chapter 13 Bankruptcy Attorneys\" href=\"https:\/\/www.duncanlawonline.com\/bankruptcy\/bankruptcy-types\/chapter-13-bankruptcy\/\" target=\"_blank\" rel=\"noopener\">Chapter 13 bankruptcy<\/a>. \u00a0We would also look at the amount of equity in their home by finding out what\u2019s owed on any mortgages and the current fair market value of the property.\u00a0 It\u2019s important to be sure we are reflecting accurate values on both the mortgage amount(s) and the property value.<\/p>\n<p>Generally speaking, the homestead exemption allows most people to be able to keep their home.\u00a0 In a Chapter 7 bankruptcy, whether a person is filing individually or joint with a spouse, the homestead exemption will likely cover what\u2019s remaining in equity.\u00a0 If you are concerned your house will exceed the exemption amounts mentioned above, we recommend consulting with an experienced bankruptcy attorney.\u00a0 Chapter 13 bankruptcy could be an option for someone who exceeds the exemption amounts but you would need to consult with a bankruptcy attorney for more accurate options. The homestead exemption is important in bankruptcy because it allows families to be able to keep their homes.<\/p>\n<p>In some cases, we find not all clients need to use the max amount of the homestead exemption.\u00a0 For example, an individual filing may have $25,000 equity in their home and therefore does not require the full amount. \u00a0A maximum of $5,000 of the $35,000 can be used for the \u201cwild card\u201d exemption, which can help protect equity in any type of property at all.<\/p>\n<p>Let\u2019s conclude with a short example of how we would use the homestead exemption of John and Jane Doe\u2019s house on 123 Main St.<\/p>\n<p style=\"padding-left: 60px;\">Fair Market Value: \u00a0 \u00a0 \u00a0 \u00a0 \u00a0$200,000<\/p>\n<p style=\"padding-left: 60px;\">First Mortgage: \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 $100,000<\/p>\n<p style=\"padding-left: 60px;\">Second Mortgage: \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 $40,000<\/p>\n<p style=\"padding-left: 60px;\">Equity: \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0 \u00a0$60,000<\/p>\n<p>We then use $30,000 of John Doe\u2019s homestead exemption and $30,000 of Jane Doe\u2019s homestead to exempt the full $60,000 of equity in their residence.
