In workers’ compensation law, a North Carolina Industrial Commission (NCIC) Form MSC1 is a Consent Order for Mediated Settlement Conference.
If an employee filing a worker’s compensation claim cannot reach an agreement with the employer or the employer’s insurance company a Form 33 requests that claim be assigned for hearing. When this happens, an Order for mandatory mediation is issued by the NCIC.
Form MSC1 allows the parties to mediate voluntarily without first having to file a Form 33 hearing request. Mediation has been highly successful in North Carolina, and according to the North Carolina Industrial Commission at least 75% of workers’ compensation cases are settled without the necessity of holding a hearing. If the mediation is not successful, a hearing will be held in front of one of the North Carolina Industrial Commission’s Deputy Commissioners.
